Verbatype — operated by NMC Apps ("Verbatype," "we," "us," or "our")

Summary (not a substitute for the terms below)

  • Verbatype turns your speech into text, mostly on your device; when you're online it may also use Groq and Google Gemini (through our server) to improve accuracy and phrasing — off until you turn it on in Settings on iPhone, automatic whenever you're online on Mac. See our Privacy Policy for details on data handling and controls.
  • Verbatype Pro is an auto-renewing subscription ($9.99/month or $79.99/year, billed by Apple) that unlocks the full feature set and higher usage limits; the monthly plan may include a 7-day free trial for new subscribers. It renews automatically unless you cancel at least 24 hours before the current period ends.
  • Word credit packs are one-time, non-expiring purchases (currently 1,000 words for $0.99 or 5,000 words for $4.99) that add cloud-processing words to your account. Credits are consumed first: while your balance is positive, every cloud word draws down that balance instead of the free weekly allowance, and you also get access to the full paid feature set.
  • BYOK Unlock is a one-time purchase ($9.99) that lets you plug in your own Groq/Gemini API keys. Those keys are stored in your device's Keychain and synchronized to your other devices by Apple's iCloud Keychain; they are never sent to our servers, and we never see or store them. Any usage under BYOK is billed by your own provider account, not by us.
  • On-device dictation is unlimited and free forever, and works fully offline. Cloud-assisted processing on the free tier has usage limits (currently soft-warning around 1,600 words/week, hard cap around 2,000 words/week) that may change; a few features (custom dictionary, weekly speech reports) require a paid tier — see Section 6.
  • Paid tiers are fair use, not unlimited. We apply fair-use and rate limits to cloud-assisted processing on every tier — see Section 6.
  • You can delete your account from inside the app, on iPhone and on Mac. We keep purchase and word-credit records afterwards, detached from you, for accounting and refunds — see Section 7 and the Privacy Policy.
  • Speech recognition makes mistakes. Don't rely on Verbatype's output, uncorrected, for medical, legal, financial, or other decisions where an error would matter — always review before you rely on it.
  • You own the text and audio you create with Verbatype. We don't sell it, we don't use it to build advertising profiles, and we don't use it to train AI models.
  • Apple isn't a party to these Terms and has no obligation to support Verbatype — that's on us.

1. Acceptance of these Terms

By downloading, installing, or using Verbatype (the "App" or "Service"), you agree to these Terms of Use ("Terms"). If you don't agree, don't use the App. These Terms apply together with our Privacy Policy, which explains what data we collect and how we handle it.

If you're using Verbatype on behalf of an organization, you're confirming you have authority to bind that organization to these Terms.

2. Eligibility

You must be at least 13 years old to use Verbatype. The App is not directed at children under 13, and we do not knowingly collect data from them (see the Privacy Policy). If you are between 13 and the age of majority in your jurisdiction, you confirm you have permission from a parent or guardian to use the App.

3. License grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use Verbatype for your personal or internal business use, on Apple-branded devices that you own or control, in accordance with Apple's Usage Rules set out in the App Store Terms of Service.

You may not: reverse-engineer, decompile, or disassemble the App except where applicable law permits; rent, lease, sell, redistribute, or sublicense the App; remove or obscure any proprietary notices; or use the App to build a competing product.

4. The Service

Verbatype converts your speech into written text. Depending on your settings and connectivity:

  • On-device recognition runs locally on your iPhone or Mac (WhisperKit, via Apple's Core ML / Neural Engine) and does not require an internet connection.
  • Cloud-assisted processing may send your audio and/or transcribed text — through our own server — to third-party AI providers (currently Groq for speech-to-text, which also receives your custom dictionary terms as a recognition hint, and Groq or Google Gemini for text normalization, depending on provider availability) to improve accuracy and phrasing, whenever you're online. On iPhone this is off until you turn it on in Settings; on Mac it runs automatically whenever you're online, with no separate on/off control yet. Details of what's sent and why are in the Privacy Policy.
  • Bring Your Own Key ("BYOK"): if you purchase the BYOK Unlock, you can supply your own Groq and/or Gemini API keys instead of using ours. Those keys are stored in your device's Keychain and synchronized to your other devices by Apple's iCloud Keychain, and are used to call the providers directly from your device for your own requests; we do not receive, transmit to our servers, or store your keys. On the BYOK path your audio and text do not pass through our servers, though we still receive usage metadata as described in the Privacy Policy. Any usage, cost, or rate limits under BYOK are between you and that provider, governed by that provider's own terms — we are not a party to that relationship and have no visibility into or control over it.

We may change, suspend, or discontinue any part of the Service, including specific AI providers, features, or usage limits, at any time. We'll try to give you reasonable notice of material changes where practical, but the Service is provided as described in Section 12 (Disclaimers).

5. Subscriptions and purchases

Verbatype offers the following paid options via Apple's In-App Purchase system:

Verbatype Pro — an auto-renewable subscription, currently offered at $9.99/month or $79.99/year (prices may change; see the App Store product page for current pricing in your region and currency).

  • Payment. Payment is charged to your Apple ID account at confirmation of purchase.
  • Auto-renewal. Subscriptions automatically renew for the same length of time unless you turn off auto-renew at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price you agreed to (subject to any price-change notice Apple or we provide).
  • Managing and canceling. You can manage or cancel your subscription any time in your Apple ID account settings (Settings → [your name] → Subscriptions on iOS, or the equivalent on macOS). Deleting the App does not cancel your subscription.
  • Free trial. The monthly subscription may include a 7-day free trial for new subscribers, as shown on the App Store product page at the time of purchase. Any unused portion of a free trial period, if offered, is forfeited when you purchase a subscription, where applicable.
  • Refunds. All billing is handled by Apple. Refund requests are handled by Apple under Apple's own refund policies — we do not have the ability to issue refunds for App Store purchases ourselves. See Apple's Report a Problem page.
  • Fair use, not "unlimited." Verbatype Pro is not marketed or sold as providing unlimited usage. Reasonable fair-use limits may apply to cloud-assisted (non-BYOK) processing to keep the Service sustainable for everyone; see Section 6.

Word credit packs — one-time, consumable purchases that add cloud-processing words to your account. Currently offered as 1,000 words for $0.99 and 5,000 words for $4.99 (prices and pack sizes may change; see the App Store product page for current offerings). Credits do not expire. Word credits are consumed from the first cloud word: while you hold a positive credit balance, the free-tier weekly allowance described in Section 6 does not apply, and every cloud-assisted word draws down your balance instead. When your balance reaches zero, your account returns to the free tier and its weekly allowance, and words already paid for with credits never count against that allowance. While your credit balance is positive, you also get access to the paid feature set described in Section 6, in addition to the words themselves. Consumable purchases are non-refundable except as Apple's own refund policies may provide (see "Refunds" above); if a credit purchase is refunded, the corresponding number of words is deducted from your balance, which may result in a negative balance.

BYOK Unlock — a one-time, non-consumable purchase, currently $9.99, that unlocks the ability to connect your own third-party AI provider API keys as described in Section 4. It is a single purchase, not a recurring charge, and (per Apple's rules for non-consumable purchases) is tied to your Apple ID and restorable on your other devices via "Restore Purchases."

Price changes. We may change prices for future billing periods. Where required by Apple or applicable law, you'll be notified of a price increase in advance and given the opportunity to cancel before it takes effect.

6. Free tier and usage limits

On-device recognition is unlimited and free forever, and works fully offline — it is not subject to any usage cap or paid tier.

Cloud-assisted processing on the free tier is limited. As of the date above, the free tier is designed around roughly 1,600 words/week of cloud-assisted processing before a soft in-app warning, and a hard cap around 2,000 words/week after which cloud-assisted processing pauses until the following week (on-device dictation continues without interruption). These numbers are illustrative of current behavior, not a contractual guarantee — usage limits (for both free and paid tiers) may change as we tune the Service, and we'll reflect current limits in the app itself rather than freezing them here. This weekly allowance applies only while your word-credit balance is zero — from the moment your balance is positive, every cloud-assisted word is drawn from that balance instead of the weekly allowance, as described in Section 5, and the weekly allowance resumes once the balance reaches zero.

Certain features — including the custom dictionary and weekly speech reports — require a paid tier: an active Verbatype Pro subscription, a positive word-credit balance, or the BYOK Unlock. We never delete your data because access to these features lapses; if your subscription ends, your credit balance runs out, or otherwise, these features simply pause. Your existing dictionary entries, history, and reports remain intact and become available again once a subscription is active, your credit balance is positive, or BYOK is unlocked.

Fair use and rate limits. We apply fair-use and rate limits to cloud-assisted (non-BYOK) processing on every tier, including paid tiers, to keep the Service available and sustainable for everyone. These limits cover, among other things, the volume of audio and text processed over a given period, the rate of requests, and use that is automated, resold, or otherwise outside normal personal or internal business use. We may enforce them by throttling your cloud-assisted requests, temporarily blocking them, suspending them, or disabling access to cloud-assisted processing, with notice where practical. On-device recognition is not affected by these limits, and we do not delete your data as a result of enforcement.

Verbatype Pro itself remains subject to reasonable fair use as described above and in Section 5 — it is not marketed or sold as unlimited.

7. Your account and device identity

Verbatype identifies your installation using a random identifier generated on the device and stored in its Keychain, rather than a traditional username/password account, as described in the Privacy Policy. That identifier is your account: your entitlements, word credits, usage, dictionary, history, and reports are attached to it. It is not shared between devices, so your iPhone and your Mac are separate accounts. You're responsible for maintaining the security of the device(s) and Apple ID you use to access the Service, and for all activity that occurs through your access.

Deleting your account. You can delete your account from inside the App, under Settings → "Data & Privacy," on iPhone and on Mac. Doing so deletes your dictation history, custom dictionary, weekly reports and suggestions, usage meters, diagnostics, and per-call usage telemetry from our servers, deletes your account record, and then erases your local history, local audio, and the account identifier on the device. This cannot be undone.

After deletion we retain your purchase and entitlement records, your word-credit ledger, your aggregated daily usage/cost totals, and Apple's signed purchase notifications, re-pointed to an anonymous placeholder identifier that cannot be used to authenticate or to reach any data. We retain them for accounting, for handling refunds Apple reports to us after the fact, and to prevent the same purchase being granted credits twice. Your per-call usage telemetry — the day-to-day, request-level records behind those totals — is deleted outright; only the daily rollup total survives, detached from you. These retained records contain Apple's transaction identifiers, the product identifier, the relevant dates, credit amounts, and aggregate usage/cost totals — no dictation audio or text, and no identifier we assigned to you. A push notification token, if you have one, is not linked to your account identifier and is unaffected by account deletion either way.

Deleting your account has these effects on your purchases: any unused word credits are lost, and cannot be restored by Apple or by us, because they are consumable purchases; an active subscription and the BYOK Unlock are tied to your Apple ID and can be restored on a new account with "Restore Purchases"; and deleting your account does not cancel your subscription — cancel it in your Apple ID subscription settings, as described in Section 5.

8. Acceptable use

You agree not to use Verbatype to:

  • Violate any applicable law, regulation, or third party's rights (including intellectual property, privacy, or publicity rights);
  • Dictate, transcribe, or process content you don't have the right to process (e.g., recording someone else without their consent where consent is legally required);
  • Attempt to gain unauthorized access to our systems, other users' data, or the third-party AI services we integrate with;
  • Interfere with, overload, or disrupt the Service or the servers/networks connected to it;
  • Use automated means (bots, scrapers) to access the Service outside of the App itself;
  • Violate Apple's Usage Rules or any applicable third-party terms (e.g., your wireless carrier's terms) that apply to your use of the App;
  • Use the Service in a way that violates U.S. export control or economic sanctions laws — you confirm you are not located in, or a resident of, any country subject to U.S. embargo, and are not on any U.S. government restricted-party list.

We may suspend or terminate access for anyone who violates this section.

9. Your content

"Your Content" means the audio you record and the text (raw, corrected, or normalized) that Verbatype produces from it.

You own Your Content. As between you and us, you retain all rights to Your Content. We don't sell it, and we don't use it to build advertising profiles.

To operate the Service, you grant us a limited license to process, transmit, and store Your Content solely as needed to: perform on-device and (when applicable) cloud-assisted transcription and normalization; sync your dictation history to your account, if that setting is enabled; and provide customer support you request. That is the whole of it: this license covers only what is needed to provide the Service to you. We do not use Your Content to train, fine-tune, or otherwise improve AI or machine-learning models, in aggregated, de-identified, or any other form. This license ends when you delete Your Content or your account via the in-app controls, except for the purchase and credit records described in Section 7, which contain none of Your Content.

You're responsible for Your Content and for having the rights necessary to have it processed as described here and in the Privacy Policy — including obtaining consent from anyone else recorded in your audio, where required by law.

10. Third-party AI processing

Some of Verbatype's accuracy comes from routing audio and/or text through third-party AI providers (currently Groq and Google Gemini) via our server, or — if you've purchased BYOK Unlock — directly from your device using your own API keys. In either case:

  • We select these providers for their transcription/normalization quality, and we limit what we send to what's needed to fulfill your request.
  • We do not control what these providers do with data on their end beyond fulfilling that request, and we are not responsible for their acts, omissions, availability, or accuracy.
  • Under BYOK, the provider relationship (including billing, rate limits, and that provider's own terms of service and privacy policy) is directly between you and the provider — we are not a party to it.

11. Feedback

If you send us feedback, suggestions, or ideas about the Service, you agree we may use them without restriction or obligation to you.

12. Disclaimer of warranties

Speech recognition is not perfect. Verbatype, like any speech-to-text system, can misrecognize words, omit content, insert incorrect words, or otherwise produce inaccurate output — including for names, numbers, medical or legal terminology, and in noisy environments or with heavy code-switching between languages. Do not rely on Verbatype's output, without your own review, for medical, legal, financial, safety-critical, or other decisions where an error could cause harm. Always review dictated text before sending, publishing, or acting on it in any context where accuracy matters.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING (WITHOUT LIMITATION) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT TRANSCRIPTION OUTPUT WILL BE ACCURATE OR COMPLETE.

Some jurisdictions don't allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (A) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; AND (B) OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (I) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (II) US $50.

Nothing in these Terms limits liability that cannot be limited under applicable law (for example, liability for gross negligence, willful misconduct, or death or personal injury caused by our negligence, where applicable law forbids limiting such liability).

14. Apple-specific terms

Verbatype is distributed through Apple's App Store, and the following terms apply in addition to the rest of this document:

  • These Terms are between you and us (Verbatype/NMC Apps), not Apple. Apple is not a party to these Terms and is not responsible for the Service or its content.
  • Apple has no obligation whatsoever to furnish any maintenance or support services for the Service.
  • In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you, if applicable, and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation with respect to the Service. Any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our sole responsibility, as set out in these Terms.
  • We, not Apple, are responsible for addressing any claims from you or a third party relating to the Service or your possession and/or use of it, including: (a) product liability claims; (b) any claim that the Service fails to conform to applicable legal or regulatory requirements; and (c) claims arising under consumer protection or similar legislation.
  • We, not Apple, are responsible for the investigation, defense, settlement, and discharge of any claim that the Service, or your possession and use of it, infringes a third party's intellectual property rights.
  • You represent and warrant that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
  • You agree to comply with any applicable third-party terms when using the Service (for example, your wireless data plan terms).
  • Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary of these Terms.

15. Termination

You may stop using Verbatype at any time by deleting the App and, if applicable, canceling your subscription through your Apple ID account settings. To delete your account and the data attached to it, use the in-app control described in Section 7 — note that deleting the App alone does not delete your account, and deleting your account does not cancel your subscription. We may suspend or terminate your access to the Service if you violate these Terms, or if we discontinue the Service or a feature, with notice where practical. Sections that by their nature should survive termination (including Sections 9, 11, 12, 13, 14, 16, and 17) will survive.

16. Changes to these Terms

We may update these Terms from time to time, for example as the Service changes or legal requirements evolve. If we make material changes, we'll update the "Last updated" date above and, where practical, provide notice in the App. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

17. Governing law and contact

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles, except to the extent superseded by applicable federal law.
